| Italy's new artificial intelligence law |
| Italy's new artificial intelligence law, Law No. 132/2025, came into force on October 10, 2025, making Italy one of the first European countries to adopt specific AI legislation. While aligned with the European AI Act, the law also introduces national provisions regulating AI use across multiple sectors including healthcare, public administration, intellectual professions, and the justice system. Notable provisions include copyright protections for works created with AI assistance, provided they result from the author's intellectual work, and amendments to the criminal code establishing aggravating circumstances for crimes committed using AI, including a new offense punishing deep fakes and artificial market manipulations created through AI systems. The law mandates that AI use must always ensure human oversight and intervention, particularly in judicial activities where final decisions remain the magistrate's exclusive responsibility. |

| Unified Patent Court begins 3-week CMS Sunrise Test Practice Period |
| The Unified Patent Court has invited external users to practice with the functionalities of its online Case Management System (CMS) that will be used during the Sunrise period. In essence, external users are offered the opportunity to test the facilities for filing requests to opt out of the jurisdiction of the Unified Patent Court. The Sunrise period is to start, according to plans, on 1 January 2023. |

Italian government names Milan as official candidate in race for UPC central division |
| Last night the Italian government chose Milan as the official candidate in the competition to host the central division of the Unified Patent Court currently based in London that will have to be reassigned following the United Kingdom's exit from the European Union as well as from the Unified Patent Court Agreement. The government chose Milan over Turin, which was supported by one of the parties in government, by reaching a compromise which will result in Turin hosting the seat of the Italian Institute for Artificial Intelligence. "The choice of Milan as candidate for the third central division of the Unified Patent Cour"?, reads the government's official statement,"is a strategic decision, intended to stregthen Italy's contribution to the development and growth of the European Union". |

| From PCT application to Italian patent: new direct route confirmed |
| Applicants will soon be able to obtain patent protection in Italy directly via an international PCT application.
Italian Law No. 34/2019 - in force since 30 June 2019 - has confirmed Legislative Decree No. 34/2019 which had recently introduced an important change in the procedure to obtain an Italian patent via an international PCT application.
So far, the only way to obtain patent protection in Italy by means of an international PCT application was via a European patent which would then be validated in Italy.
By amending the Italian Industrial Property Code, the new legislation has now also made it possible to obtain an Italian patent via an international PCT application by opening an Italian national phase directly. |

| Italy finalises implementation of EU Trademark reform package and Unified Patent Court Agreement |
| The Italian government has issued two legislative decrees that finalise the implementation into national law of the so-called EU Trademark reform package, of EU provisions on the unitary patent and of the Unified Patent Court Agreement.
Specifically the Italian government's Council of Ministers of 20 November 2018 approved two legislative decrees concerning intellectual property rights. Both decrees will come into force after publication in the Italian Official Journal. |

| Republic of San Marino joins Hague system for international design registration |
| As from 26 January 2019 it will be possible to designate the Republic of San Marino in applications for the registration of international designs.The Republic of San Marino, a city-state in the Marche region on the eastern coast of Italy, deposited its instrument of accession to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs on 26 October 2018.This latest accession means there are now 70 states which can be designated in an international application for design registration. |
